Terms of Service

Tiny Bastion · Effective date: 22 October 2026

These Terms of Service (the “Terms”) are an agreement between you and the developer of Tiny Bastion, shown as the seller on the App Store and Google Play listings (“we”, “us”, “the developer”). They apply to Tiny Bastion: Tower Defense on iOS, iPadOS and Android, its updates, in-game items and online features (the “Game”), and to mjabbari.com/tinybastion (the “Site”). To the maximum extent permitted by law, by downloading, installing or using the Game you accept these Terms. If you do not accept them, do not use the Game.

Please read sections 10 to 15 carefully. To the maximum extent permitted by law, they limit our liability, require you to bring claims individually and not as part of a class, and require claims to be brought within one year. Nothing in these Terms removes rights that the law in your country says cannot be removed.

1. Eligibility

To the maximum extent permitted by law, you must be old enough to use the App Store or Google Play in your country. If you are under the age of majority, a parent or legal guardian must accept these Terms for you and is responsible for your use of the Game, including purchases.

2. Licence

To the maximum extent permitted by law, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Game on devices you own or control, for private, non-commercial entertainment, as permitted by the store’s usage rules. The Game is licensed, not sold. We and our licensors keep all rights not expressly granted.

3. Apple App Store terms

If you downloaded the Game from the Apple App Store, the following also applies, to the maximum extent permitted by law:

4. Fair play

To the maximum extent permitted by law, you must not: copy, modify, distribute, sell or rent the Game; reverse engineer or decompile it except where the law expressly allows; cheat, use bots, exploits or modified clients; manipulate scores, leaderboards, purchases, rewards or ads; submit offensive, infringing or misleading leaderboard names; interfere with our services or those of our providers; or use the Game unlawfully. We may remove leaderboard entries, reset progress gained unfairly, or restrict online features for breaches, subject to applicable law.

5. Gems, rewards and other virtual items

To the maximum extent permitted by law, gems, heroes, upgrades, stars, rewards and other virtual items (“Virtual Items”) are a limited licence to use content inside the Game. They are not money or property, have no cash value, cannot be exchanged for money or anything of value, and cannot be sold, traded or transferred unless the Game expressly allows it. We may change, rebalance, rename, limit or remove Virtual Items and their prices or effects. Virtual Items are stored on your device and can be lost if you delete the Game, clear its data, change or reset your device, or if your device fails. To the maximum extent permitted by law, we are not responsible for lost Virtual Items or progress and we have no obligation to restore or replace them, except non-consumable purchases that the store can restore under section 6.

6. Purchases and refunds

The Game offers in-app purchases. Prices and terms are shown by the App Store or Google Play before you confirm. Apple or Google processes all payments, and we never receive your full payment details. To the maximum extent permitted by law, all purchases are final and non-refundable, except as required by law or by the store’s own refund policy. Refund requests are handled by the store: Apple or Google Play. Consumable items such as gems are used up when delivered or spent. Non-consumable items such as No Ads and the Starter Pack can be restored with the same store account where the Game offers Restore Purchases. “No Ads” removes the ads described at purchase. It may not remove optional rewarded ads that you choose to watch. If a purchase is not delivered, email us with your store receipt or order number. Never send passwords or card details.

7. Advertising

The Game shows ads supplied by Google AdMob and its partners, including optional rewarded ads. To the maximum extent permitted by law, we do not control or endorse third-party ads, the products they promote or the websites they link to. We are not a party to any transaction between you and an advertiser, and we do not guarantee that an ad, a rewarded ad or its reward will always be available.

8. Third-party services

The Game relies on third-party services including Google AdMob, Google Firebase (Analytics and Crashlytics), Unity Gaming Services, Unity In-App Purchasing, the App Store and Google Play. Their own terms and privacy policies apply. To the maximum extent permitted by law, we are not responsible for third-party services, their content, availability, changes, outages, errors or data handling, or for any loss arising from them. See our Privacy Policy.

9. Updates, availability and data loss

To the maximum extent permitted by law, we may update, change, suspend or discontinue the Game, any feature, leaderboard or online service at any time, with or without notice. Some updates may be required to keep playing. We do not guarantee that the Game will be available, compatible with your device, uninterrupted, secure or free of errors, or that progress, scores or Virtual Items will be preserved. You are responsible for your device, internet connection and any data charges.

10. No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAME, THE SITE AND ALL CONTENT, VIRTUAL ITEMS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, PROGRESS, VIRTUAL ITEMS, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE GAME, THE SITE, THIRD-PARTY SERVICES OR ADS, OR THESE TERMS, HOWEVER CAUSED AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE GAME, THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE GAME DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 10.

12. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the developer and its licensors and service providers from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Game, your leaderboard names, or your violation of any law or third-party right.

13. Governing law and courts

To the maximum extent permitted by law, these Terms and any dispute arising out of or relating to them or the Game are governed by the laws of the Emirate of Dubai and, where applicable, the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. To the maximum extent permitted by law, the courts of Dubai have exclusive jurisdiction. Please email us first so we can try to resolve any concern informally.

14. Class-action waiver

To the maximum extent permitted by law, you and we agree that each may bring claims against the other only individually and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding.

15. One-year limit on claims

To the maximum extent permitted by law, any claim arising out of or relating to the Game, the Site or these Terms must be filed within one (1) year after the claim arose. Otherwise it is permanently barred.

16. Intellectual property

To the maximum extent permitted by law, the Game, its name, artwork, music, code and other content belong to the developer or its licensors and are protected by intellectual property laws. Third-party assets remain the property of their owners and are used under licence.

17. Termination

To the maximum extent permitted by law, you may stop using the Game at any time by deleting it. We may suspend or end your access to online features if you breach these Terms. Sections 5 and 9 to 19 survive termination.

18. Your mandatory rights

Some countries do not allow certain warranty exclusions, liability limits, choice of law or court, class-action waivers or claim time limits. Where that is the case, those provisions apply only to the maximum extent permitted by law, and nothing in these Terms excludes or limits liability or rights that cannot be excluded or limited under applicable law, including mandatory consumer rights and liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

19. Changes and general terms

To the maximum extent permitted by law, we may update these Terms by posting a new version with a new effective date. Continuing to use the Game after that date means you accept the update. If any provision is found unenforceable, the rest remain in effect and that provision is enforced to the maximum extent permitted by law. These Terms, together with the Privacy Policy and the applicable store terms, are the entire agreement between you and us about the Game. Our failure to enforce a provision is not a waiver. You may not assign these Terms. We may assign them in connection with a transfer of the Game.
