Terms of Use
The short version
- Cocktail Land is for adults of legal drinking age. Please drink responsibly and never drink and drive.
- Recipes, amounts, calorie estimates and ingredient details come from third-party databases and may be incomplete or wrong. Check labels for allergens.
- The App is provided “as is”, with no guarantees, and our liability is limited as far as the law allows.
- Purchases and subscriptions are handled by Apple, and refunds go through Apple.
This summary is for convenience. The full Terms below are what apply.
1. Agreement
These Terms of Use (the “Terms”) are an agreement between you and the developer and publisher of Cocktail Land (“we”, “us”, “our”). They apply to the Cocktail Land mobile application on iOS and iPadOS and its widgets (together the “App”), and to the website at mjabbari.com/cocktailland, including the shared shopping-list page (the “Site”).
By downloading, installing, opening or using the App or the Site, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, do not use the App or the Site, and delete the App.
2. Legal drinking age
The App contains recipes and information about alcoholic drinks. You may use the App only if you are at least 18 years old and of legal drinking age in the country where you live, whichever is higher (for example, 21 in the United States). You must be legally able to accept these Terms, and you must not use the App where doing so, or consuming alcohol, is against the law or your local rules. The non-alcoholic recipes in the App do not make it suitable for children.
3. What the App is
The App is a recipe reference and organiser for drinks. It shows recipes, ingredients, photos and food pairings that it receives from third-party databases, and it lets you keep favourites, a list of bottles you own and a shopping list on your device. Features such as Make Now, servings and unit conversion, calorie estimates, Today's Special, Feeling Lucky, aisle grouping and quick lists work automatically, using simple rules, with no human review. They may be wrong: for example, a drink may be shown as one you can make when it is not, an amount may be converted or rounded inaccurately, or an ingredient may be placed in the wrong group. A drink's position, label or selection is not a recommendation or endorsement.
4. Drink responsibly
- We do not encourage the consumption of alcohol or excessive drinking. Any decision to drink, and how much, is yours alone.
- Never drink and drive, operate machinery, swim or do anything else that alcohol makes unsafe.
- Do not drink alcohol if you are pregnant or trying to become pregnant, if you are taking medication that interacts with alcohol, if you have a health condition that alcohol may affect, or if your doctor has advised you not to.
- Never serve alcohol to anyone under the legal drinking age or to anyone who is intoxicated.
- Follow the laws and rules on buying, carrying, preparing and consuming alcohol where you are.
- Take care with glassware, knives, fire, flaming drinks, dry ice, raw eggs and other hazardous ingredients or techniques. You are responsible for preparing drinks safely and hygienically.
5. Information only, not advice
All content and information in the App and on the Site is provided for general information and entertainment only. It may be incomplete, out of date or inaccurate, and you should not rely on it as your only source for any decision. In particular:
- Recipes, amounts, glassware and instructions come from third parties and may contain errors. Alcohol strength varies by brand and by how a drink is made.
- Calorie figures are rough estimates and are not nutritional information.
- Ingredient lists may be incomplete and do not list every allergen or additive. Always read product labels yourself, especially if you have an allergy, intolerance or dietary restriction.
- Labels such as “non alcoholic” or “optional alcohol” come from the recipe source and may be wrong; some ingredients, such as bitters or extracts, contain alcohol.
Nothing in the App or on the Site is medical, nutritional, health, legal or other professional advice. Seek a qualified professional where appropriate.
6. Third-party content
- Recipes, photos, videos, names and trademarks shown in the App belong to their owners, including TheCocktailDB and TheMealDB and their contributors. We claim no ownership of them.
- Brand and product names, such as the names of spirits and mixers, are used only to identify ingredients. The App is not affiliated with, sponsored by or endorsed by any drinks brand or producer.
- If you believe content shown in the App infringes your rights, email apps.jabbari@gmail.com with details of the content, your rights in it, and your contact information. We will review every request and, where appropriate, remove or stop showing the content. We may also remove any content at any time at our discretion.
7. Links and third-party services
The App and the Site link to and rely on services we do not control. These include RapidAPI, TheCocktailDB, TheMealDB, YouTube, Google AdMob, Apple (App Store, StoreKit) and the operating system of your device. To the maximum extent permitted by law, we are not responsible for their content, accuracy, availability, security, privacy practices or legality, or for any loss caused by them. Your use of them is at your own risk and under their own terms. Any dealings between you and a third party are solely between you and them.
8. Shared lists
When you send a shopping list, the list is carried inside the link itself. Anyone who has the link can open and read it. You are solely responsible for the content you put in a list and for who you share it with. To the maximum extent permitted by law, we are not responsible for how a link is used, forwarded or stored by you, the people you share it with, or the apps you share it through.
9. Acceptable use
You agree not to:
- copy, republish, redistribute, sell or commercially exploit content obtained through the App;
- scrape, data-mine, decompile, reverse-engineer, modify or create derivative works of the App, except as the law expressly allows;
- interfere with, overload or disrupt the App, the Site, or the services they connect to;
- tamper with ads, purchases, subscriptions or licence checks;
- use the App or the Site to break any law, including laws on alcohol, cybercrime and intellectual property, or to infringe anyone's rights.
10. Our rights and your licence
The App and the Site belong to us and are protected by intellectual-property laws. This covers the software, design, interface, graphics, icons and our own original text. Third-party content is excluded. We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on Apple devices you own or control, for your own non-commercial use, under these Terms and the App Store rules. All rights not expressly granted are reserved. If you send us feedback or suggestions, we may use them freely and without any obligation to you.
11. Ads, purchases and subscriptions
- The free version shows ads served by Google AdMob. Advertisers alone are responsible for their ads and for any products, services or claims in them. Seeing an ad is not an endorsement by us.
- Remove ads is a one-time, non-consumable purchase that removes ads only.
- Cocktail Land Premium is an auto-renewing monthly subscription. Payment is charged to your Apple account at confirmation of purchase. It renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel it in your App Store account settings. Cancelling stops future renewals; it does not refund the current period.
- All purchases are processed by Apple, not by us, under Apple's terms. We never see your payment details. Refunds are handled only by Apple under its refund policies. We cannot issue refunds ourselves, except where the law requires it.
- You can restore purchases on devices using the same Apple account, from Settings in the App. We are not responsible if a purchase cannot be restored because of a store, account or device problem outside our control.
- Prices are set in the App Store and may change. A purchase or subscription covers the App as it exists from time to time and does not include any promise of future features, updates or availability. Features included in Premium may change.
12. Changes and availability
To the maximum extent permitted by law, we may change, add, suspend or remove any feature or content, and may update or stop offering the App or the Site, at any time and without notice or liability. We do not promise that the App will be available in every country, work on every device or operating-system version, or keep receiving updates or support. Features depend on third-party services that may change or stop working.
We may update these Terms from time to time. The “Effective” date above shows the latest version. Material changes will be posted on this page. If you keep using the App or the Site after an update, you accept the updated Terms.
13. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App, the Site and all content, information and services in them are provided “as is”, “as available” and “with all faults”, without warranty of any kind. We expressly disclaim all warranties and conditions, whether express, implied or statutory. These include warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, timeliness, reliability, quiet enjoyment, title and non-infringement. We do not warrant that the App or the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, that content will be accurate or complete, or that the App, the Site or the servers they rely on are free of viruses or other harmful components. You use the App and the Site at your own risk.
14. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we, or our contractors, licensors or service providers, be liable for any of the following, however caused and under any theory of liability, even if we have been advised of the possibility of them and even if a remedy fails of its essential purpose:
- any indirect, incidental, special, consequential, exemplary or punitive damages;
- any loss of profits, revenue, business, opportunity, goodwill, reputation or data;
- any personal injury, illness, allergic reaction, intoxication, accident or property damage arising from preparing or consuming any drink or food, or from any recipe, amount, estimate or label in the App or on the Site;
- any loss or damage arising from: (a) your use of, or inability to use, the App or the Site; (b) any content, information or link in or through them; (c) any error, omission, delay, interruption or inaccuracy; (d) any third-party content, website, advertisement or service; (e) any decision or action you take based on the App or the Site; or (f) unauthorised access to, or alteration of, your device or data.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the App, the Site or these Terms shall not exceed the amount you actually paid for the App or in-app purchases during the twelve (12) months before the event giving rise to the claim, or ten US dollars (USD 10) if you made no purchases.
These limits apply to the maximum extent permitted by law, and they are an essential basis of the bargain between us: the App is offered free or at a very low price because of them. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the exclusions and limitations above apply only to the maximum extent permitted by law, and nothing in these Terms limits any right that cannot lawfully be limited.
15. Your responsibility and indemnity
You are responsible for how you use the App and the Site, for any drink you prepare, serve or consume, and for any decision you make based on them. You are also responsible for your device, its security and settings, your internet connection, and any data or mobile charges. Your favourites, bar shelves, shopping list and settings are stored only on your device; we cannot recover them, and to the maximum extent permitted by law we are not liable for any loss, corruption or deletion of them for any reason. To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless us and our contractors, licensors and service providers. This covers any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising from: your use or misuse of the App or the Site; any drink you prepare, serve or consume, or serve to others; your breach of these Terms or of any law; content you add or share; or your violation of anyone else's rights.
16. Events beyond our control
To the maximum extent permitted by law, we are not responsible for any failure or delay caused by events beyond our reasonable control. These include failures or changes of recipe databases, third-party services, the App Store, operating systems, internet or power networks, hosting providers or cyber-attacks; acts of government; natural disasters; epidemics; war; and civil unrest.
17. Ending these Terms
You may stop using the App at any time by deleting it. Deleting the App does not cancel a subscription; cancel it in your App Store account settings. We may suspend or end your access to the App or the Site at any time, with or without notice, including if you breach these Terms. When these Terms end, your licence ends and you must stop using the App. Sections 3 to 6, 8, 10 and 13 to 20, and any other terms that by their nature should survive, will survive termination.
18. Disputes and governing law
- Talk to us first. If you have a complaint, email us and give us 30 days to try to resolve it informally before you start any formal proceedings.
- Governing law. These Terms, and any dispute or claim arising out of or relating to them, the App or the Site, are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, without regard to conflict-of-law rules.
- Courts. The courts of the Emirate of Dubai have exclusive jurisdiction, and you and we submit to them. This does not apply where the mandatory law of the country you live in gives you the right to bring a claim in your local courts.
- Individual claims. To the extent permitted by law, claims may be brought only on an individual basis and not as a plaintiff or class member in any class, collective or representative action.
- Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.
19. Apple
- These Terms are between you and us only, not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
- Your licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple's Licensed Application End User License Agreement also applies. Where it conflicts with these Terms, these Terms prevail to the extent permitted.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Apple is not responsible for handling any claims by you or a third party relating to the App or your use of it. This includes product-liability claims, claims that the App fails to meet any legal or regulatory requirement, consumer-protection and privacy claims, and claims that the App infringes a third party's intellectual-property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
20. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App and the Site.
- Severability. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the rest will remain in full effect.
- No waiver. If we do not enforce a right, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if the App is sold.
- Export. You must comply with all applicable export-control and sanctions laws.
- Language. These Terms are written in English. Any translation is for convenience only, and the English version prevails.
