Terms of Service

These Terms of Service ("Terms") govern your use of Tilehearts ("the Game"), published by Mohammad Jabbari ("we", "us"). By downloading, installing or playing the Game you agree to these Terms. If you do not agree, do not use the Game.

1. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own private, non-commercial entertainment. All rights not expressly granted are reserved.

2. What You May Not Do

• Copy, sell, rent, sublicense or redistribute the Game or any part of it
• Reverse engineer, decompile, disassemble or modify the Game
• Use cheats, bots, modified clients, memory editors or save editors
• Interfere with the Game's operation, or with advertising or purchase systems
• Falsify leaderboard scores or exploit bugs for advantage
• Use the Game for any unlawful purpose

We may suspend or terminate your access if you breach these Terms.

3. Virtual Items and In-Game Currency

The Game contains virtual coins, boosters, characters and other items ("Virtual Items").

• Virtual Items have no monetary value and are not your property. You receive a limited licence to use them within the Game only.
• Virtual Items cannot be exchanged for real money, goods or anything of value outside the Game.
• Virtual Items cannot be transferred, sold or traded between players or accounts.
• We may change, rebalance, limit or remove Virtual Items at any time, without notice and without compensation.
• Virtual Items are lost if you uninstall the Game, change device, or clear your device data. We are not able to restore them.

4. Purchases and Refunds

All purchases are processed by the Apple App Store or Google Play. We do not process payments and never receive your payment details.

All purchases are final and non-refundable, except where a refund is required by applicable law or granted at the discretion of the relevant app store. Refund requests must be made directly to Apple or Google under their policies; we cannot issue refunds.

Non-consumable purchases, such as "Remove Ads", can be restored through the app store on the same account. Consumable purchases, such as coin packs, are consumed on use and cannot be restored.

5. Advertising

The Game is supported by advertising. Ad content is supplied by third parties and we do not control, endorse or take responsibility for it. Purchasing "Remove Ads" removes banner and full-screen advertising; optional rewarded videos remain available because they grant in-game items in return.

6. Third-Party Services

The Game uses third-party services including Google AdMob, Apple Game Center, Unity and the app stores. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their availability, content, conduct or practices.

7. Availability and Changes

We may modify, update, suspend or discontinue the Game, or any feature of it, at any time and without notice or liability. We do not guarantee that the Game will be available at all times, will be uninterrupted, or will be free of errors.

8. Disclaimer of Warranties

The game is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the game will meet your requirements, operate without interruption, be secure, be free of errors or defects, or that any defects will be corrected. You use the game entirely at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, progress, virtual items, or device damage, arising out of or in connection with your use of or inability to use the game, whether based on warranty, contract, tort or any other legal theory, and whether or not we have been advised of the possibility of such damage.

To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the game or these terms shall not exceed the greater of (a) the total amount you paid to us for the game in the twelve months preceding the claim, or (b) five US dollars (US$5.00).

10. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, liability or expense, including reasonable legal fees, arising from your use of the Game, your breach of these Terms, or your violation of any law or third-party right.

11. Age Requirement

The Game is intended for users aged 13 and over. By using the Game you confirm that you are at least 13 years old, or that you have permission from a parent or legal guardian who agrees to these Terms on your behalf.

12. Termination

You may stop using the Game at any time by uninstalling it. We may terminate or suspend your licence immediately, without notice, if you breach these Terms. Sections 3, 4 and 8 through 13 survive termination.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, except where applicable consumer law entitles you to bring proceedings in your country of residence.

14. Changes to These Terms

We may revise these Terms at any time. Changes take effect when posted on this page and the "Last updated" date is amended. Continuing to use the Game after a change means you accept the revised Terms.
