Music IR: Instant Rhythm
Effective date: 31 October 2026
Please read these Terms carefully. They include a limitation of liability (section 15), an indemnity (section 16), a one-year time limit for claims (section 18), a class-action waiver (section 19), and a choice of Dubai, UAE law and courts (section 20). Nothing in these Terms removes rights that the law where you live says cannot be removed.
1.1 These Terms of Use ("Terms") are an agreement between you and the developer of Music IR ("we", "us", "our"). They govern your use of the Music IR app for iPhone, iPad and CarPlay (including on Apple silicon Macs and Apple Vision Pro), its widgets and share extension, and any updates, content and services we provide through it (together, the "App").
1.2 To the maximum extent permitted by law, by downloading, installing or using the App you accept these Terms and our Privacy Policy (https://mjabbari.com/musicir/legal/privacy). If you do not accept them, do not use the App.
1.3 To the maximum extent permitted by law, these Terms supplement Apple's Licensed Application End User License Agreement (the "Apple Standard EULA", https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If the two conflict, these Terms apply, except where the Apple Standard EULA or section 22 requires otherwise.
To the maximum extent permitted by law, you must be old enough to form a binding contract where you live, or use the App with the consent and supervision of a parent or legal guardian who accepts these Terms for you. The App includes unrestricted web access and is not intended for children. Parents are responsible for supervising their children's use and for using the device's Screen Time and content restrictions.
3.1 To the maximum extent permitted by law, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and only for your own personal, non-commercial use.
3.2 To the maximum extent permitted by law, you may not:
3.3 Some components of the App are open-source software provided under their own licences (see Settings › Acknowledgements in the App). Those licences govern those components, and nothing in these Terms limits your rights under them.
4.1 "Your Content" means any audio, video, image, recording, playlist, file or other material that you import, download, record, create, store, convert, extract, share or play with the App.
4.2 To the maximum extent permitted by law, you keep whatever rights you have in Your Content, and you are solely responsible for it. You confirm that you own Your Content or have all the rights, licences and permissions needed to import, download, copy, convert, extract, play, share and otherwise use it with the App.
4.3 To the maximum extent permitted by law, we do not host, store, review, index or control Your Content. It stays on your device (and in your device backups and, for songs you choose to sync, your own iCloud Drive). We are not responsible for Your Content or for anything you do with it.
5.1 The App's browser can detect audio and video files that a web page offers (for example a link to an MP3 or MP4 file, or a media file the page plays) and lets you choose to save them. Detection and saving are not available on YouTube or on the DRM-protected music and video streaming services that the App excludes, the same rules apply in Private tabs, and the App does not capture streams, does not save media protected by digital rights management (DRM) or encryption, and does not bypass any technical protection. To the maximum extent permitted by law, we may disable this feature, or exclude any website or type of file from it, at any time and in any version of the App, without notice.
5.2 To the maximum extent permitted by law, you are solely and fully responsible for every file you download, and for making sure you have the right to download it. Before you download a file, you must make sure that:
5.3 To the maximum extent permitted by law, the App is a general-purpose tool, like any web browser, and the decision to download a file is yours alone. We do not encourage, authorise or approve downloading any content you do not have the right to download, and we do not grant you any rights in content you find or download through the App. A file being reachable or downloadable does not mean you have permission to keep it.
5.4 To the maximum extent permitted by law, we have no responsibility or liability for any file you download, its legality, accuracy, quality, safety or suitability, for any harm it causes to your device or data, or for any claim by a rights holder or website arising from your downloads. Downloads go directly from the website to your device; we never receive, host or transmit them.
5.5 If you are a rights holder and believe the App is being used to infringe your rights, email apps.jabbari@gmail.com with the details (the website and file concerned and your contact details). Because we do not host any content, we cannot remove files from users' devices, but we will review the notice and may block the website or file type in a future version of the App.
6.1 Through the App you can reach third-party websites and services and their content, including websites in the browser, search engines and their suggestions, podcast feeds and directories (including Apple's), internet radio streams and the Radio Browser directory, the Music News feed, Apple Music, Apple's ShazamKit song recognition and iTunes services, iCloud, Siri, Google services, the App Store and share links ("Third-Party Services").
6.2 To the maximum extent permitted by law:
6.3 Websites and other content you reach through the App may include material that is inaccurate, offensive, indecent, objectionable or unsuitable for children. To the maximum extent permitted by law, you accept that risk and agree that we have no liability for that material.
To the maximum extent permitted by law, Apple Music features require your own Apple Music subscription and are provided by Apple under Apple's terms. Apple Music content cannot be downloaded, converted, exported, shared through Sync Music, or used in the Music Visual Creator or the games. Apple Music is a trademark of Apple Inc. Music IR is not affiliated with or endorsed by Apple, and we are not responsible for Apple Music, its catalogue or its availability.
To the maximum extent permitted by law, the following features work with files you already have, and you are solely responsible for having the rights to use those files in that way:
9.1 Premium is offered as auto-renewing subscriptions. Earlier buyers of the legacy one-time "Remove Ads" purchase receive lifetime Premium, as described in section 9.4. Prices, periods and what Premium includes are shown in the App before you buy.
9.2 Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically at the same price and for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple Account settings. If a free trial is offered, any unused part of it ends when you buy a subscription.
9.3 To the maximum extent permitted by law, all purchases are processed by Apple and are subject to Apple's terms. Refunds are handled only by Apple under its policies (https://reportaproblem.apple.com); we cannot issue refunds, view your payment details or restore purchases made with a different Apple Account. Purchases belong to the Apple Account used to buy them.
9.4 To the maximum extent permitted by law, Premium is a licence to use certain features, not a sale of property. We may change, add or remove Premium features, provided that you keep the benefit you paid for until the end of your current paid period (or, for the legacy one-time "Remove Ads" purchase, for as long as the App offers Premium). The legacy one-time purchase grants lifetime Premium: all Premium features and no ads served by the App, for as long as the App offers Premium, unless the purchase is refunded. "Lifetime" means the lifetime of Premium in the App, not a fixed period or the life of any person. Premium has no cash value, cannot be transferred, and confers no ownership of any virtual item.
9.5 To the maximum extent permitted by law, Premium, including lifetime Premium, removes the advertising that the App itself serves, including rewarded ad offers. It does not remove advertising or sponsorship that is part of third-party content, such as websites opened in the browser, podcast episodes, radio streams or news sources, and we are not responsible for that content. Removal of the Music IR badge from Music Visual Creator videos is a Premium feature that we may change under section 9.4.
9.6 To the maximum extent permitted by law, the free version may let you choose to watch a rewarded ad to use a Premium feature once or to get more Fix My Library fixes. Rewarded ads are optional and may not always be available. A rewarded unlock or fix is not a purchase, has no cash value, cannot be transferred, confers no ownership of any virtual item, and may be changed, limited or withdrawn at any time.
To the maximum extent permitted by law, the free version of the App may show ads from third parties, including rewarded ads you choose to watch. Ads are the responsibility of the advertiser and the ad network. We do not endorse any advertised product or service and are not responsible for ads, the products or services they promote, the websites they lead to, or any dealings between you and an advertiser.
11.1 To the maximum extent permitted by law, the App stores your library, playlists, recordings, downloads, statistics and settings on your device. You are solely responsible for keeping your own backups. We are not responsible or liable for any loss, corruption, deletion or unavailability of Your Content or other data, however caused, including by updates, migration from earlier versions, changes you accept in Fix My Library, iCloud syncing, iOS changes, device failure, storage limits, deleting the App, or deletions you make.
11.2 To the maximum extent permitted by law, listening statistics, game scores, favourites and similar in-app records are provided for convenience and may be inaccurate or reset.
Our Privacy Policy explains how information is handled. To the maximum extent permitted by law, by using the App you acknowledge that third-party services you choose to use (for example your search engine, websites, podcast hosts, radio stations and Apple's song recognition) receive information directly from your device under their own policies.
To the maximum extent permitted by law, we may change, suspend or discontinue any part of the App (including features, Third-Party Services, supported formats and supported iOS versions) at any time, with or without notice, and without liability to you. We are not obliged to provide updates, support or maintenance, except as stated in section 22.
14.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND EVERYTHING AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, TITLE AND NON-INFRINGEMENT.
14.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, THAT IT WILL PLAY, CONVERT, DOWNLOAD, SYNC OR CORRECTLY IDENTIFY ANY PARTICULAR FILE, SONG, STREAM OR WEBSITE, THAT DATA WILL NOT BE LOST, OR THAT ANY THIRD-PARTY SERVICE OR CONTENT WILL BE AVAILABLE, ACCURATE, LAWFUL OR SAFE.
15.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, FILES, GOODWILL OR USE, OR FOR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THE APP, THESE TERMS, YOUR CONTENT, DOWNLOADS, THIRD-PARTY SERVICES OR ADS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT INCLUDING NEGLIGENCE, STATUTE OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) TEN US DOLLARS (USD 10).
15.3 These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud, or (where applicable) your statutory consumer rights.
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the developer and its agents, contractors and licensors from and against any claim, demand, loss, liability, damage, fine, cost and expense (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) any file you download, convert, extract, share or publish using the App; (c) your use of any website or Third-Party Service through the App; (d) your breach of these Terms or of any law or third-party right, including copyright; or (e) your use of Sync Music, the Voice Recorder, Fix My Library or the Music Visual Creator.
To the maximum extent permitted by law, your licence ends automatically if you break these Terms. You can stop using the App at any time by deleting it. Sections 4 to 8 and 10 to 22 survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS MUST BE STARTED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION AROSE. OTHERWISE IT IS PERMANENTLY BARRED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. A COURT MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
20.1 To the maximum extent permitted by law, these Terms and any dispute or claim arising out of or in connection with them or the App (including non-contractual disputes) are governed by the laws of the Emirate of Dubai and, where applicable, the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
20.2 To the maximum extent permitted by law, the courts of Dubai, United Arab Emirates, have exclusive jurisdiction over any such dispute, and you and we submit to their jurisdiction.
20.3 Before starting any proceedings, you agree to email apps.jabbari@gmail.com describing the dispute and to allow 30 days to try to resolve it informally.
20.4 If you are a consumer living in a country whose law gives you the right to bring proceedings in your local courts or to rely on the mandatory consumer-protection rules of your local law, nothing in this section 20 takes that right away.
To the maximum extent permitted by law:
To the maximum extent permitted by law, the following applies to your use of the App on Apple devices:
(a) Parties. These Terms are between you and the developer only, not with Apple Inc. ("Apple"). The developer, not Apple, is solely responsible for the App and its content.
(b) Scope of licence. The licence in section 3 is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing, where available.
(c) Maintenance and support. The developer, not Apple, is solely responsible for any maintenance and support of the App, to the extent stated in these Terms or required by applicable law. Apple has no obligation to provide any maintenance or support for the App.
(d) Warranty. The developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are, as between the developer and Apple, the developer's responsibility, subject to the disclaimers and limits in these Terms.
(e) Product claims. The developer, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. These Terms do not limit the developer's liability to you beyond what is permitted by applicable law.
(f) Intellectual property. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, the developer, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim, to the extent required by these Terms.
(g) Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
(h) Developer contact. Questions, complaints or claims about the App should be sent to the developer shown as the seller of Music IR on its App Store product page, at apps.jabbari@gmail.com.
(i) Third-party terms. You must comply with the terms of any third-party agreement that applies when you use the App (for example your wireless data agreement, and the terms of websites and services you use through the App).
(j) Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
